  1. Is the decision the judge rendered a disappointment? Yes. Are we totally unhappy with the decision? No we aren’t. It is my opinion that Wainfleet did win maybe not the big time wine we were hoping for but a win, nevertheless. Why you may ask. Because the judge said the bylaw is invalid not illegal which if you will recall is what the Toronto lawyers representing the other side told us it would be if we went ahead with passing it. They also told us that we had no authority to pass such a bylaw. Well guess what the judge said: we were within our right to pass a bylaw like this that parallels the GEA. Last by certainly not least he said there was no evidence that we passed this bylaw in bad faith. So another win for us.

    Just imagine the outcome if the definition of “property” had been to the judge’s liking.

    The judge vindicated us on 3 major points which other municipalities can go forward with in confidence that they too will be able to pass such a bylaw.

    Things are not as bad as they may have appeared.
